FLUXDASH END USER LICENSE AGREEMENT (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between
you (“User”) and Gurdeep Bangar (“Licensor”) for the software FluxDash
(“Software”).
By installing, accessing, or using FluxDash, you agree to be bound by this
Agreement. If you do not agree, do not install or use the Software.

1. LICENSE GRANT
----------------
Subject to compliance with this Agreement, the Licensor grants you a limited,
non-exclusive, non-transferable, revocable licence to install and use FluxDash.
You may install and activate the Software on the number of devices permitted by
the licence purchased.
2. RESTRICTIONS
---------------
You must not:
* Share, rent, lease, sublicense, or distribute the Software to any third
party.
* Reverse engineer, decompile, or disassemble the Software except where
legally permitted.
* Modify or create derivative works of the Software.
* Circumvent any licence validation or Microsoft Store enforcement mechanisms.
* Use the Software in any way not expressly permitted under this Agreement.
3. ADMINISTRATOR PRIVILEGES (UAC)

FluxDash requires Administrator privileges in order to access hardware
interfaces, system sensors, and operating system components.
By granting these permissions, you acknowledge that:
* You voluntarily approve elevated system access.
* You understand elevated privileges may affect system configuration
visibility.
* You acknowledge that Administrator privileges are required for certain
hardware monitoring functionality. While FluxDash is designed only to read
hardware information, elevated permissions are necessary to access certain
hardware interfaces and operating system components.
4. HARDWARE MONITORING DISCLAIMER
---------------------------------
We strive to provide accurate hardware monitoring using system-reported data and
third-party interfaces. However, sensor availability and accuracy depend on the
underlying hardware, drivers, the operating system, and LibreHardwareMonitor.
FluxDash is intended for informational purposes only and should not be relied
upon for safety-critical decisions.
You acknowledge and agree that:
* Sensor readings (including temperature, voltage, frequency, fan speed,
and power metrics) may be inaccurate or inconsistent.
* Hardware behaviour may vary based on manufacturer, BIOS, firmware,
drivers, and operating system updates.
* FluxDash does not guarantee detection or support for all hardware
configurations.
5. NO CONTROL OR SYSTEM MODIFICATION
------------------------------------
FluxDash is strictly a read-only monitoring tool. It does not:
* Overclock hardware.
* Modify voltage or power settings.
* Control fans or pumps.
* Modify BIOS or firmware settings.
* Perform system tuning or hardware reconfiguration.
6. THIRD-PARTY SOFTWARE (LIBREHARDWAREMONITOR)
----------------------------------------------
FluxDash incorporates, bundles, or is distributed with open-source components,
including but not limited to LibreHardwareMonitor.
These components are licensed under their respective open-source licences (such
as the Mozilla Public License Version 2.0). Copies of applicable licences are
included with the Software.
Such third-party components are provided “as is” and the Licensor, as well as
the
original open-source contributors and authors of those components, disclaim all
warranties and conditions, express or implied.
Neither the Licensor nor the contributors of the third-party components shall
be liable for:
* Errors, omissions, or inaccuracies in third-party components.
* Security, stability, or performance issues arising from third-party software.
* Compatibility issues between third-party components and your system.
* Any direct, indirect, special, incidental, or consequential damages
arising from the use of such third-party software.
You explicitly acknowledge and agree that:
* LibreHardwareMonitor communicates locally with FluxDash using a loopback
network
interface. No hardware sensor data is transmitted to external servers as part
of this
communication.
* This local connection is used solely to transfer sensor readings to the
FluxDash frontend.
* No data is transmitted externally, and the port is configured to be closed
to the external network and public internet.
7. OPTIONAL THIRD-PARTY DEPENDENCIES (PAWNIO)

FluxDash may prompt you to install third-party software components, including
but not limited to PawnIO.
You acknowledge that:
* PawnIO is not included with FluxDash.
* PawnIO is developed, distributed, and maintained independently by third
parties.
* Installation of PawnIO is entirely optional and user-initiated.
* FluxDash does not control, guarantee, or assume responsibility for PawnIO.
The Licensor shall not be liable for any installation, operation, behaviour,
or consequences of third-party software installed at your request.
8. TRIAL VERSION
----------------
FluxDash may be provided as a time-limited or feature-limited trial version.
* The trial is for evaluation purposes only.
* Certain features may be restricted or disabled.
* Continued use beyond the trial period requires a valid licence obtained
through the Microsoft Store or authorised distribution channel.
* Trial licences may be revoked or discontinued at any time.
9. LICENSING AND PAYMENTS
-------------------------
FluxDash may be distributed via authorised channels, including the Microsoft
Store and Paddle.com Market Ltd (or the relevant Paddle entity acting as
Merchant of Record).
When purchasing a licence via Paddle.com, payments, order fulfilment, and
transactional support are handled by Paddle. The Licensor does not store or
process your payment information. Licence validation and entitlement management
are handled by the respective distribution platform.
9.1 Updates
A purchased licence includes updates for the period specified at the time of
purchase. After this period expires, the Software will continue to function, but
future updates may require renewal or the purchase of an additional update
entitlement.
9.2 Support
Technical support is provided in accordance with the support period included
with your purchase. The Licensor does not guarantee response times or resolution
of every issue.
9.3 Refunds
Refunds are governed by the refund policy of the authorised reseller or Merchant
of Record from whom you purchased the Software.
9.4 Privacy
Your use of the Software may involve the processing of personal data as
described in the Privacy Policy available at Legal\PRIVACY_POLICY.txt
9.5 LICENCE ACTIVATION
----------------------
A valid licence is required to activate and use FluxDash, including trial
versions.
The Software requires an active internet connection during activation and may
periodically verify the validity of your licence thereafter. Failure to
successfully validate a licence may result in the Software being unavailable
or certain functionality being disabled.
You must not attempt to bypass, modify, interfere with, or circumvent the
Software's activation, licensing, or entitlement mechanisms. Any attempt to do
so may result in suspension or termination of your licence without notice.
10. NO WARRANTY
---------------
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED ON AN
“AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER
EXPRESSED, IMPLIED, OR STATUTORY.
The entire risk as to the quality, performance, and accuracy of the Software
is with the User. Should the Software prove defective in any respect, the
User (and not the Licensor or its third-party suppliers) assumes the entire
cost of any necessary servicing, repair, or correction.
The Licensor explicitly disclaims all warranties, including but not limited to:
* Implied warranties of merchantability and fitness for a particular purpose.
* Warranties of non-infringement or quiet enjoyment.
* Warranties that the Software will be secure, error-free, uninterrupted,
or free of defects.
* Any warranties regarding the accuracy, completeness, or reliability of
hardware data or metrics displayed by the Software.
No use of the Software is authorised under this Agreement except under this
disclaimer.
11. LIMITATION OF LIABILITY
---------------------------
NOTHING IN THIS AGREEMENT SHALL LIMIT OR EXCLUDE THE LICENSOR'S LIABILITY FOR:
(A) DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE;
(B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR
(C) ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW
(INCLUDING STATUTORY RIGHTS UNDER THE UK CONSUMER RIGHTS ACT 2015, TO THE
EXTENT THEY APPLY AND CANNOT BE WAIVED).
SUBJECT TO THE FOREGOING, TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNDER NO
CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER IN CONTRACT, TORT (INCLUDING
NEGLIGENCE), BREACH OF STATUTORY DUTY, STRICT LIABILITY, OR OTHERWISE, SHALL
THE LICENSOR BE LIABLE TO THE USER FOR ANY DAMAGES OF ANY CHARACTER ARISING
OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE SOFTWARE, INCLUDING BUT
NOT LIMITED TO:
* Loss of data or corruption of files.
* Hardware malfunction, instability, or physical component damage.
* Computer failure, system downtime, or operating system instability.
* Loss of profits, revenue, or goodwill.
* Business interruption.
* Any indirect, special, exemplary, or consequential damages.
This limitation shall apply even if the Licensor has been advised of the
possibility of such damages.
In no event shall the Licensor's aggregate liability arising out of or in
connection with this Agreement or the use of the Software exceed the total
amount actually paid by the User for the Software.
Where the Software is provided free of charge (including trial versions), the
Licensor shall, to the maximum extent permitted by applicable law, have no
liability for any loss or damage arising from the use of the Software, except
where such liability cannot be excluded or limited by law.
You acknowledge that use of the Software is at your sole risk.
12. INTENDED USE
----------------
FluxDash is intended solely as a PC hardware monitoring application. It is not
designed, certified, or intended for use in medical, industrial, automotive,
aviation, military, life-support, or other safety-critical systems where failure
could result in injury, death, or significant property damage.
13. USER RESPONSIBILITY
-----------------------
You are solely responsible for:
* Maintaining backups of your data.
* Ensuring system compatibility.
* Monitoring system stability when using hardware monitoring tools.
* Any configuration or system interpretation based on information displayed
by the Software.
14. TERMINATION
---------------
This Agreement is effective until terminated.
The Licensor may terminate your licence if you breach any term of this
Agreement.
Upon termination, you must cease all use of FluxDash and uninstall the Software.
15. EXPORT AND LEGAL COMPLIANCE
-------------------------------
You agree to comply with all applicable export control and sanctions laws.
16. GOVERNING LAW
-----------------
This Agreement is governed by the laws of England and Wales, and any disputes
shall be subject to the exclusive jurisdiction of the courts of England and
Wales.
17. SEVERABILITY
----------------
If any provision of this Agreement is found to be unenforceable, the remaining
provisions shall remain in full force and effect.
18. ENTIRE AGREEMENT
--------------------
This Agreement constitutes the entire agreement between you and the Licensor
regarding FluxDash and supersedes any prior agreements or understandings.
The Licensor may update this Agreement from time to time. Continued use of the
Software after an updated Agreement becomes effective constitutes acceptance of
the revised Agreement.
